Locke Reynolds Receives Defense Verdict for Marion County Sheriff's Department
INDIANAPOLIS, November 2005 – Anthony W. Overholt and Kevin C. Schiferl obtained a defense verdict for the Marion County Sheriff's Department when a federal jury in Indianapolis decided that the Marion County Sheriff's Department was not responsible for the death of an inmate who was beaten while in the City-County Building's lockup.
Larry T. Thomas pleaded guilty to aggravated battery for beating Kenneth Carpenter in the lockup. Thomas attacked Carpenter on July 1, 2003; he died six days later.
The family of Carpenter claimed that crowding in the lockup caused short tempers among the inmates and led to the assault. The suit also claimed there were too few correctional officers on hand to keep the inmates safe. A closed-circuit video recording of the attack confirmed for jurors that jail staff responded appropriately.
