Products Liability Toxic Substance Litigation

Toxic Substance Litigation

Toxic substance litigation has evolved from simple product liability litigation to complex mass litigation involving product claims against manufacturers and sellers, premises claims against users, and contractor claims against installers and builders. Whether a single case or mass filing, toxic exposure litigation requires an understanding of how state and federal law, the science of exposure, and medical causation interact in each case. Our experience in a variety of toxic exposure areas gives us the depth of experience needed to handle all these aspects of toxic exposure litigation. And just as important to the client, we understand how to manage these intersecting areas to provide the most economical and efficient representation possible.

We have extensive experience in document sweeps, discovery due diligence, and discovery management essential to representing manufacturers, premises owners, and contractors in mass and individual toxic tort claims. We developed a state of the art system to manage our toxic exposure cases and create or coordinate industry or companywide management of repetitive litigation in multiple jurisdictions. We structured our toxic exposure team to take advantage of each team member's specialized knowledge and insure the efficient handling of the case. We also have a great deal of experience adapting our technologies and team structure to the systems and reporting requirements of the individual clients. Our use of technology and a team oriented approach to case handling gives us the flexibility and creativity needed to handle the ever changing toxic exposure landscape. We have extensive experience in joint and multiple representation where the volume and nature of litigation make cost sharing and cost containment imperative to the client's very ability to defend itself against unfounded claims.
