Motor Carrier Law
Our Motor Carrier Group provides comprehensive
business and legal services for insured and self-insured commercial carriers, including common and private carriers, lessors and lessees, owner/operators, shippers, brokers and their insurers. Our services range from helping clients ensure compliance with myriad intrastate, interstate and international regulations to representing them in alternative dispute resolution procedures, including mediation or arbitration, and in state and federal courts.
24-Hour Emergency/Accident Response
We can arrange investigators and provide legal services in response to major emergencies/accidents on a 24-hour basis. This helps us to control the scope of the accident investigation and statements, and to protect the results of the investigation and statement testimony through the attorney-client privilege where available. The 24-hour emergency response feature is also available in a number of other states as a result of our membership in The Harmonie Group, a national association of law firms.
Representation in state and federal courts generally takes the form of defending clients in litigation of personal injury, wrongful death and property damage claims. The logging of millions of miles on streets, highways and interstates exposes motor carriers to unusually high levels of risk. We work with our clients to, where possible, identify and minimize these risks, to counsel and coordinate insurance coverage for those risks, and to defend claims that inevitably arise in the course of operations. We also work with clients on related matters, including labor and employment, products liability and worker's compensation issues.
Our Motor Carrier Group is comprised of attorneys with significant experience in this broad range of issues. The group includes the chairs or past chairs of our Insurance Services, Business Litigation and Products Liability groups, including a past-president of the Defense Research Institute. Our attorneys have extensive experience working with all types of professionals, including accident reconstructionists, healthcare providers and accountants, which makes it possible to successfully defend lawsuits or achieve acceptable resolution of disputes by alternative means. We represent clients in litigation in jurisdictions throughout the United States, have extensive experience in complex litigation and have successfully handled matters at both the trial and appellate court levels.
