Intellectual Property and Technology Law
Intellectual property is an expanding area of the law in the United States and around the world. New technologies and innovations in virtually every field of human endeavor are spawning new products and services, new companies and industries, and new ways of communicating, sharing information and conducting business. This technology-driven global market presents opportunities, and challenges, to those whose success is tied to the creation and control of intellectual property. Intellectual property encompasses a variety of intangible property rights recognized at law, including patentable inventions, trade secrets and know-how, trade names and trademarks, copyrights, industrial and commercial designs, publicity rights and similar proprietary interests.
Through our Intellectual Property Group, we work with individual authors, artists, inventors, engineers, scientists and with businesses ranging from start-ups to multinational corporations, to secure and enforce their intellectual property rights. We provide our clients with services in the area of trademark and copyright prosecution, licensing and litigation, trade secrets and publicity rights. We prepare license agreements, assignments and various contracts. We regularly conduct searches, provide advice on registerability, prepare and prosecute trademark and service mark applications based on use, and intent-to-use, handle renewals and related filings and coordinate and oversee foreign applications filed by our associates in other countries. We handle oppositions and other proceedings before the Trademark Trial and Appeal Board, assert and defend pre-litigation infringement claims and cease and desist demands on behalf of our clients. And, we work as co-counsel with attorneys registered with the U.S. Patent and Trademark Office to assist in the preparation and prosecution of patent applications.
We work closely with attorneys in our Business Litigation Group to represent clients in federal cases involving infringement of trademarks, copyrights, trade secrets and publicity rights. With increasing frequency, the Internet in general, and domain names in particular, are involved in these cases. We have ongoing disputes pending in the courts, including a dispute with one of the approved dispute resolution service providers under the Rules for Uniform Domain Name Dispute Resolution Policy of the Internet Corporation for Assigned Names and Numbers (ICANN). We work vigorously to prosecute and defend suits involving our clients' intellectual property interests in state and federal courts throughout the country.
