Family Law
Family law is a practice area that reaches farther than its name suggests. Many of our legal constructs have evolved from early attempts to define family relationships, to protect family assets, to resolve family disputes and to establish rights and responsibilities in family disputes that cannot be resolved amicably. Ironically, too many people do not make prudent use of family law, presumably because they are uncomfortable discussing the legal ramifications of family decisions or the actions or decisions of a particular family member; therefore, they make decisions without forthright discussion, without understanding the wisdom behind the laws that are designed to protect them and without acknowledging that time sometimes brings changes in family relationships that they cannot foresee.
Through our Family Law Group, we work with individuals and families on a broad spectrum of legal matters. Some involve trying to foresee and address potential problems, through pre-marital or prenuptial agreements, post-marital or postnuptial agreements and cohabitation agreements. Others involve helping families work through problems that they cannot resolve on their own, through family mediation. Still others involve helping individuals and families work through the dissolution of marriages and the child custody, child support, visitation rights and other post-dissolution issues that often accompany them.
In addition to these essentially marriage-related issues, we work with individuals and families on adoption, paternity and change of name proceedings. In conjunction with attorneys in our Tax and Estate Planning groups, we help families identify and resolve issues that arise when a change in family structure occurs, generally through divorce or death. We also work closely with attorneys in other practice groups, as necessary and appropriate, when family relationships include business relationships, joint ownership of real estate and other assets and litigation of family issues that can only be resolved in court.
