Labor and Employment Law

The workplace has become a legal minefield. Statutes and regulations at the state and federal levels, combined with court decisions, make every significant personnel action a potential liability event. In addition, employers face a changing and increasingly complex array of obligations in areas such as safety, recordkeeping, employee benefits and compensation. Labor unions have accelerated organizing activities and have become more aggressive in existing bargaining relationships.

In response, we are in a position to offer clients the benefits of a broad base of experience. Our philosophy is that victory is often won when battle is avoided, so we routinely provide preventive counseling for employers on such matters as personnel policies, handling troublesome terminations and preserving union-free status. We also regularly conduct in-house training programs for managers and supervisors on avoiding labor and employment-related liabilities.

Through our Labor & Employment Group, we work with employers in administrative proceedings and litigation involving disputes over such matters as employment discrimination, ERISA benefits, wrongful discharge and related claims, workplace defamation, employee privacy, wage-hour disputes, OSHA investigations, employment contracts and employee competition/business secrets. We also work with employers on union matters, such as representation elections, collective bargaining, contract administration and arbitration, as well as in proceedings before the National Labor Relations Board.
