Construction Services
Construction projects, because they are by nature complex projects typically involving large sums of money, multiple local, state and federal boards and administrative agencies, and multiple stakeholders, are fraught with potential for disagreement and litigation. In fact, guiding a construction project from inception to completion, through owners, developers, architects, engineers, construction managers, general contractors and sub-contractors, with potential delays at every stage due to zoning, financing, insurance, labor and employment issues, material shortages, contractor performance, and even the weather, probably raises as many legal issues as any other business endeavor. Sometimes these issues are relatively straightforward, but occasionally they are quite complex. In either case, our objective is to resolve them efficiently and cost-effectively.
Through our Construction Group, we work with these stakeholders to resolve legal issues before they arise, if possible, through careful execution of appropriate contracts and other performance agreements. If an issue cannot be resolved by reference to existing contracts and agreements, we work with clients to explore whether alternative dispute resolution techniques, such as mediation, can resolve the issue without litigation. If the issue cannot be resolved without arbitration or litigation, we work with clients to defend and/or prosecute their claims.
Over the years, our Construction Group has grown into one of the largest in the state devoted to fidelity, surety and construction law. In addition to representing the owners, architects, engineers and various contractors mentioned above, we represent sureties that issue contract bonds, such as bid bonds, performance bonds, payment bonds and a wide variety of fidelity bonds, such as financial institution bonds, bankers blanket bonds, probate / guardianship bonds, forgery bonds, trustee bonds and public official bonds. We have experience in both private and public sector construction settings, and we work with a wide range of clients - large and small - on a remarkable range of projects - large and small.
