Banking & Creditors' Rights Law

Banking law and creditors' rights are complex areas of the law, and their complexity is compounded when they intersect a variety of other legal disciplines. Fortunately, we have a dedicated industry team of attorneys with extensive experience in general banking matters and in the highly-specialized areas they often intersect. We use a multi-disciplinary approach in which attorneys from other practice groups are brought in to augment the work of the industry team on highly specialized issues. The firm is one of a few in Indiana that is deemed preeminent by its peers in banking law, and we are listed as such in the Martindale-Hubbell Bar Register of Preeminent Lawyers .

Through our Banking and Creditors' Rights Group, we work with banks and other financial institutions on commercial loan closings, consensual workouts, bankruptcies and commercial foreclosures. We provide general advice and coordination on compliance issues specific to Indiana, such as the Indiana Uniform Consumer Credit Code, real estate law, consumer loan documentation and new product approvals, as well as all applicable areas of Federal law, such as Truth-in-Lending, Equal Credit, RESPA, electronic funds laws and banking regulations. We work with clients on major strategic issues, but we also take great pride in our ability to help clients resolve the day-to-day problems that often confront them and require immediate response. We also represent banks and other financial institutions in a variety of claims made against them, in conjunction with attorneys in our Business Litigation Group.

We represent a number of financial institutions, private parties and insurance companies in negotiating, documenting and closing commercial loans, on a national basis. We also represent several regional banks in Indiana on similar matters. We work with local, regional and national clients in negotiation and workout of troubled loans, bankruptcies, receiverships and commercial foreclosures. We represent financial institutions in large-volume purchases and sales of financial assets, including mortgage pools. And, finally, we represent banks and other financial institutions in business litigation, including class action litigation on retail banking products. We price our services competitively, and we work closely with clients to investigate and implement equitable, innovative fee arrangements, to help them control their costs.
