Bert Dahm has significant experience in a broad range of product liability
(notably medical device matters), complex business, commercial, and multi-district
litigation. He has been lead counsel in multiple state and federal courts,
including courts of appeal, throughout the U.S.

Includes medical device; pharmaceutical; marine; automotive; food processing
Representative Cases/Transactions:
- Recently retained as lead counsel by Zimmer, Inc. in a highly publicized lawsuit
brought by one of Zimmers competitors.
- Successfully represented Zimmer, Inc. in over 40 lawsuits filed in various
federal district courts by plaintiffs who claimed Zimmers product was
defective.
- As lead trial and national counsel, successfully represented Zimmer, Inc. in
MDL-1014, litigation involving thousands of plaintiffs suing Zimmer and
others in hundreds of lawsuits throughout the U.S.
- Helped marine manufacturers defeat so-called propeller guarding allegations
brought by various plaintiffs in lawsuits in various state and federal
courts.
- As lead counsel successfully represented Lenex Steel in New Jersey state
court lawsuit alleging breach of construction contract.
Verdicts & Recent Opinions:
- Obtained summary judgment for Zimmer, Inc. this summer in lawsuit filed
against Zimmer and others in New Mexico state court by a plaintiff alleging
antitrust violations.
- Obtained summary judgment for Zimmer, Inc. this spring in federal court in
Miami in lawsuit brought by former Brazilian distributor seeking a multimillion
dollar award. Case involved Brazilian law.
- Excluded plaintiffs experts and obtained summary judgment for
Brunswicks Mercury Marine division in lawsuit filed by a product liability
plaintiff who alleged he was severely injured by one of Mercury Marines
products.
